The availability of all services is based on the current conditions and our discretion. We have the authority to change or halt any services without prior notice.
3. Booking and Reservations
3.1 Booking Process
To secure a charter, you are required to:
- Have reached the age of 18 or older
- Submit accurate and comprehensive details
- Remit the necessary down payment as per the booking confirmation
- Accept these Terms & Conditions
3.2 Confirmation
We will only affirm your booking once payment is made and we provide you a written confirmation. We hold the right to deny service at our own discretion.
3.3 Availability
All charter bookings rely on the accessibility of the yacht and suitable weather. We strive to cater to your scheduling preferences as best as we can.
4. Payment Terms
4.1 Pricing
All costs are established in € and cover applicable taxes unless stated differently. We may alter prices without prior notice.
4.2 Payment Schedule
- Initial payment: 50% of the whole charter fee due at the time of reservation
- Remaining balance: Due no later than 48 hours before the charter's start
- Any extra fees (if applicable): To be paid at the charter's end
4.3 Payment Methods
Acceptable payment methods include major credit cards, electronic bank transfers, and validated cheques. Secure, encrypted systems are utilized for processing payments.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If cancelled more than 72 hours before departure: Full repayment minus service fees
- For cancellations made 24-72 hours before departure: Half refund
- Cancelling less than 24 hours before departure: No reimbursement possible
5.2 Weather Cancellations
In circumstances where the weather is deemed unsafe for sailing by our captain, you will be given the options to:
- Reschedule the charter to another available slot with no extra charges
- Receive a full repayment if an alternate date cannot be agreed upon
5.3 Mechanical Issues
If there are mechanical issues with the assigned vessel, we will attempt to offer a suitable replacement. Should no replacement be available, a full refund will be issued.
6. Safety and Conduct
6.1 Safety Requirements
All guests are expected to:
- Adhere to all directions given by the crew
- Use safety equipment as instructed
- Duly report any medical conditions that may influence their safety
- Stay within the safe areas designated on the yacht
6.2 Prohibited Items
It is prohibited to bring aboard items such as:
- Containers made of glass
- Illegal materials
- Weapons or firearms
- Non-alcoholic beverages beyond reasonable consumption
- Pets (exceptions made if pre-authorized)
6.3 Conduct
Travelers must behave respectfully at all times. Should passenger conduct prove harmful to safety or disrupt the positive experience of others, we reserve the right to end the charter early, with no refund provided.
7. Liability and Insurance
7.1 Our Liability
Liabilities on our part are confined to the payment received for your charter. We are not liable for:
- Injuries caused by guests' negligence
- Personal items lost or damaged
- Indirect, incidental, or punitive damages
- Delays originating from weather or situations outside our control
7.2 Insurance Coverage
Robust marine insurance is held, protecting our vessels and operations. However, it is recommended that passengers arrange their own travel and personal insurance.
7.3 Assumption of Risk
Participation in our charter activities signifies you understand that there are inherent risks associated with water-based activities, and you agree to accept those risks.
8. Modifications and Itinerary Changes
Itineraries, routes, or schedules may be adjusted due to weather conditions, safety procedures, or operational demands. We guarantee to make all efforts to provide a comparable alternative experience.
9. Force Majeure
We shall not be responsible for any delay, cancellation, or alteration caused by events beyond our reasonable control, which includes, but is not limited to:
- Extreme weather situations
- Natural calamities
- Government directives
- Seaport closures
- Vehicular malfunctions
10. Privacy and Data Protection
